EVERYTHING is possible in Myanmar under the rule of law. Some wonder how many face does the rule of law have in Myanmar. Because it could be altered as they wants. It depend on the offenders who violate the law. If the offender is close to military, the case is downgraded and even disappeared in some cases. No matter how media shout for justice. They can put those outspoken journalist for defamation under libel. Myanmar has one saying that "money win over law" mean that you can solve out problem if you have enough money.
I could understand why corruption and bribery is widely happening in our land through my study on law. Most of punishment are put by range, saying maximum punishment and fines only. The judge has wide option to turn verdict at his own hand. It make offenders get some chance to bribe the judges to favor their wrongdoing. Myanmar has passed corruption law now and we heard no case of punishing by that law since. Creating law along and not focus on enforcement is the same as there is no law I believe. Parliament keep issuing several laws and amending outdated laws to apply on. The judicial system is heavily influenced by executives. Its mean there is no independence judicial that is reliable to public.
Most recently the president amended the draft corruption law by advising to minimize the punishment year and consequently the parliament approved it. The law read that those present valued more than 300k is considered giving bribe. What does it mean? A person who pay govt official a present less than 300k is not entitled to be arrested under corruption law? It is a bit funny to me. At the same time, executives asked to reduce punishment from 3 years max to 1 year. It speak a lot that they, govt staffs, themselves is committing the offences and trying to dilute the intensity of the corruption so that they/their relatives can get minimum suffer when they commit it.
Our lady ASSK keep saying how important the rule of law is for any nation and how does it missing on the land of Myanmar. We got to change the whole system and mindset of our govt staffs while paying them enough salaries. Otherwise, our country will drag on the league of LDC. What a shameful slogan boosting toward developed nation while govt executives itself is taking bribery or commission through big deals without being arrested to date. Their master, China is conducting nationwide operation on corrupted officials and successful. Our leaders should follow this trend with China while they're taking all advice from China for other cases to press our people.
